Payment and Service Agreement

Advance Payment:

The estimated service amount must be paid in advance before the start of the service. Recurrent payments or deposits will be required before the start of the next service cycle to ensure continuity.

Extra Charges:

Additional charges apply if the family requests the same caregiver to continue services on their scheduled off days, personal leaves, or public holidays. Transportation costs will vary if the caregiver is required to travel with the patient to different locations.

Liability for Caregiver Injuries:

The family assumes full responsibility for treating any caregiver injury sustained during service, including medical expenses.

Review and Changes to Service:

All service requests are subject to supervisor review. Adjustments may be made based on patient needs and caregiver availability.

General Terms

Validity of Agreement:

This agreement remains valid from the signing date until the end date, unless extended or terminated by mutual consent.

No Direct Payments:

No advance should be paid to the caregivers directly. Any advance payments should be authorized and processed by 24Care@home’s authorized personnel only. 24Care@home will not be liable or responsible for any cash advance given to the caregivers without our knowledge. The caregiver will only perform tasks as outlined in this Agreement. Any changes to the scope must be documented and signed by both parties.

Caregiver Amenities:

If the caregiver is required to stay at the beneficiary's premises, the family must provide basic amenities such as accommodation, food, and proper rest time at their own expense. Caregivers will not engage in household chores like cooking or cleaning beyond patient-related duties.

Family Conduct:

The family and patient must treat caregivers with respect and ensure a safe and supportive working environment.

Caregiver Leave Policy:

In compliance with labor laws, caregivers are entitled to two days off for every month of service. Caregivers working beyond scheduled leave will be compensated accordingly.

Service Continuity and Replacement:

24Care@home reserves the right to replace any caregiver if necessary, ensuring the replacement has equivalent qualifications. In case a caregiver is found unsuitable, 24Care@home will arrange a replacement within 7 working days.

Termination of Service in Case of Patient’s Death:

If the patient passes away, the agreement is terminated immediately, and no refunds are provided.

Jurisdiction:

Any disputes will fall under the jurisdiction of courts in Chennai.

Risk and Liability

Acknowledgment of Risks:

The Beneficiary acknowledges that caregiving services inherently carry risks such as infection, injury, or death, and they assume shared responsibility in maintaining their safety.

No Liability for 24Care@home:

24Care@home shall not be liable for any infection, injury, death, or financial loss resulting from the caregiving services provided. Beneficiaries agree to indemnify 24Care@home against claims arising from injury, illness, or damage experienced by the beneficiary or third parties during the service period.

Refund Policy:

No refunds will be provided under any circumstances once the service has commenced. Any payments made in advance are non-refundable, and no refund will be issued for cancellations, early terminations, or services already rendered. By agreeing to these terms, the beneficiary acknowledges and accepts that all payments are final.

Beneficiary Responsibility for Loss or Damage:

The beneficiary and their family will be responsible for any damage, injury, or illness caused to the caregiver, property, or other third parties due to their negligence. The above indemnity terms will apply to the beneficiary’s legal heirs, executors, and representatives.
